Understanding the way our fees are calculated
UK Probate’s fixed fees are driven by the forms HMRC require us to complete on your behalf.
HMRC have two different forms for Inheritance Tax purposes. Every estate has to complete one of these forms even if there is no tax to pay.
We use the forms to classify estates as ‘Simple’ or ‘Complex’. An estate classified Complex may not seem that complicated, and have only a few assets, but the requirement from HMRC to use the full IHT400 (to claim the Residence Nil Rate Band, or if there is a Trust or Foreign Assets) make the estate naturally more Complex.
HMRCs definition of a Simple Estate (Excepted Estate) and criteria to use form IHT205 are as follows:

All other estates require the full IHT400 which has lots of schedules and attachments, and is sent to HMRC before the Probate Registry (unlike the IHT205). We classify all estates that require the IHT400 as Complex Estates for our pricing plans.
